Welcome to Shuno ("App"). These Terms of Service ("Terms") are a legally binding agreement between you ("User" or "you") and the developers of the App ("we," "our," or "us"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

To use our Services, you must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18, you must have your parent or legal guardian’s permission to use the Services.



To access certain features of our App, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for your personal, non-commercial use.



You agree not to use our Services for any illegal, harmful, or abusive activity. This includes, but is not limited to:
- Infringing upon the rights of others.
- Distributing incorrect information through, or based on our platform.
- Interfering with the operation of our Services.
- Using the Services for any purpose that is unlawful or prohibited by these Terms.

All content included in the App, such as text, graphics, logos, images, and software, is the property of the developers or its content suppliers. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from the App without our express written permission.

Our Privacy Policy explains how we collect, use, and disclose information about you. By using our Services, you agree that we can collect and use your information in accordance with our Privacy Policy.

Our Services may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the availability, accuracy, or content of such third-party services.

We may terminate or suspend your account and access to our Services at any time, without notice and for any reason, including if we believe you have violated these Terms. Upon termination, you must cease all use of the Services and delete any copies of the App from your devices.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.



OUR APP IS IN AN EARLY DEVELOPMENT PHASE AND SHOULD NOT BE CONSIDERED A REPLACEMENT FOR TRADITIONAL METHODS OF HEARING TESTING OR DIAGNOSIS. THE RESULTS AND RECOMMENDATIONS PROVIDED BY OUR APP ARE PRELIMINARY AND SHOULD NOT BE RELIED UPON. USERS SHOULD CONSULT MEDICAL PROFESSIONALS FOR ANY CONCERNS REGARDING HEARING HEALTH. WE SHALL NOT BE LIABLE FOR ANY CONSEQUENCES OR DECISIONS MADE BASED ON THE USE OF THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTlY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
(C) ANY CONTENT OBTAINED FROM THE SERVICES; AND
(D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

You agree to indemnify, defend, and hold harmless us, and our affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

We reserve the right to modify these Terms at any time. When we do, we will post the updated version on this page. If you continue to use our Services after such modifications, you agree to be bound by the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or our Services will be resolved through final and binding arbitration under the rules of the American Arbitration Association.
